1. Purpose
The purpose of these Terms and Conditions is to set forth the conditions for the use of the Ameego (hereinafter referred to as "Ameego") service by Playmore Co., Ltd. (hereinafter referred to as the "Company").
2. Supplementary Governing Rules and Regulations
Matters not stipulated in these Terms and Conditions shall be governed by applicable laws and regulations or the individual service terms, operating policies, and rules (hereinafter referred to as "Detailed Guidelines") established by the Company. In case of any conflict between these Terms and Conditions and the Detailed Guidelines, the Detailed Guidelines shall prevail.
3. Effectiveness and Amendment of Terms
1.
These Terms and Conditions take effect upon being posted in the Ameego application operated by the Company. By downloading and using the application, users are deemed to have agreed to these Terms and Conditions. Any amendments to these Terms and Conditions shall take effect upon the date of implementation specified by the Company.
2.
The Company reserves the right to amend these Terms and Conditions. In such cases, the Company shall notify users of the revised Terms and Conditions and their effective date at least seven (7) days in advance (or thirty (30) days in the case of changes that may significantly impact users). The revised Terms and Conditions shall take effect from the date specified in the notification.
3.
Users have the right to reject the amended Terms and Conditions. If a user disagrees with the changes, they may discontinue using the service and terminate the service agreement (withdraw from membership).
4. Notification to Users
1.
The Company may notify users via electronic means, such as email or SMS, or by other appropriate methods.
2.
The Company may provide general notifications to all users by posting them on the website for at least seven (7) days.
5. Commencement of Service Use
1.
The Company shall, in principle, approve the use of the service upon receiving a request for a service agreement.
2.
The Company may postpone approval due to a lack of available resources or other circumstances.
3.
The Company may impose usage restrictions based on membership grades, such as limiting access time, usage frequency, or available service menus according to its policies.
6. Registration and Modification of Member Information
1.
Users may utilize the Company’s services by completing the membership registration form provided by the Company.
2.
Users may view and modify their personal information at any time through the personal information management page. However, certain essential information required for service management may not be modified.
3.
Users must promptly update their information online or notify the Company via email or other means if any information provided during membership registration changes.
4.
Users shall be responsible for any disadvantages resulting from failure to update their information.
7. Management and Protection of Member Information
1.
Users are responsible for managing their ID and password and must not allow third parties to use them.
2.
The Company may restrict the use of an ID if it risks exposing personal information, is antisocial, or could be mistaken for another member or service operator of the Company.
3.
If a user becomes aware that their ID and password have been stolen or is being used by a third party, they must immediately notify the Company and follow its instructions.
4.
The Company shall not be responsible for any damages resulting from a member’s failure to notify the Company or follow its instructions regarding unauthorized use of their ID or password.
8. Obligations of the Company
1.
The Company shall comply with applicable laws and these Terms and Conditions.
2.
The Company shall establish a security system to protect users' personal information and publicly disclose and adhere to its privacy policy.
3.
To ensure stable service, the Company shall promptly repair or restore any equipment malfunctions or failures. However, in the following cases, the Company may temporarily suspend all or part of its services without prior notice under the following circumstances and will notify users afterward without delay:
•
When urgent system inspections, expansions, replacements, or maintenance are necessary
•
When a system replacement is deemed necessary to introduce new services
•
When normal service is impossible due to system or equipment failures or network issues
•
In cases of emergencies, power outages, or other force majeure events
4.
The Company does not explicitly or implicitly guarantee that the services provided are free of errors (including security vulnerabilities, bugs, or rights violations), or that they are stable, reliable, accurate, complete, valid, suitable for a particular purpose, or continuously available.
9. Privacy Protection
1.
The Company values user privacy and complies with relevant laws and regulations. The company protects personal information through its personal information protection policy and informs users of the purpose and method of use of information and the company's efforts to protect personal information.
2.
The Company's privacy policy does not apply to external web pages linked from its services.
3.
The Company shall not be liable for unauthorized disclosure of user account information unless such disclosure is due to the Company's negligence.
10. Collection and Use of Personal Information
1.
Users may refuse to consent to the collection and use of mandatory personal information, but such refusal may limit access to the service.
2.
The Company may collect and store data such as IP addresses, cookies, service usage history, device information, OS versions, carrier network names, and app versions during service use.
11. User Responsibilities
1.
Users (including both members and non-members) must apply for service use with truthful information. If a user provides false or third-party information, they cannot claim any rights against the Company, and the Company shall not be liable for resulting damages.
2.
Users must comply with these Terms and Conditions, other regulations established by the Company, and official notices.
3.
Users shall not engage in activities that interfere with Company operations or damage the reputation of the Company or others.
4.
Users must promptly update their registered information (e.g., address, contact information, email) online if there are any changes. Users bear responsibility for any disadvantages caused by failure to update their information.
5.
Users must not select IDs, nicknames, or other names used within the service that violate the Company’s policies (e.g., impersonation of another person, similar names, obscenity, or infringing on third-party rights).
6.
Users may not transfer or dispose of their service rights or contractual status without the explicit consent of the Company.
7.
Users must not exceed the intended use of services (e.g., copying, transmitting, modifying, or redistributing). The Company reserves the right to block such actions and claim compensation.
8.
Specific usage guidelines are provided in the Company’s operational policies. Violating these Terms and Conditions or the operational policies may result in service restrictions, legal consequences, or other penalties.
12. Service Provision
1.
The Company provides the following services:
•
Language learning service and related additional services through visual images and audio content based on generative AI
•
Content creation service based on generative AI
•
Conversation service for language learning based on generative AI
2.
The company's services are provided 24 hours a day, 365 days a year, in principle. However, they may be temporarily suspended due to company circumstances.
3.
In the event of service suspension, the Company will notify users in advance (or afterward in urgent cases) by posting an announcement on its website.
4.
Some services may be offered as paid services.
5.
The Company may impose usage restrictions on certain services, notifying users accordingly.
6.
Ameego services are available only to users aged 14 and older. By registering for Ameego, users confirm they are 14 or older. Legal representatives must consent to minors’ use of paid services requiring legal approval.
13. Service Changes and Restrictions
1.
The Company may restrict or suspend all or part of its services in the event of emergencies such as war, natural disasters, or a suspension of telecommunication services.
2.
The Company may change its services due to operational or technical needs. In such cases, the Company will notify users in advance by posting details of the changes and the schedule on its website (or afterward in case of unavoidable technical issues).
3.
If the Company decides to fully terminate a service due to operational reasons, it will announce the termination at least thirty (30) days in advance on its website. Users cannot request compensation for unused periods of paid services if the termination date is announced. For paid content or services with a stated "permanent" usage period or without a specified usage period, the termination date will be considered the end of the content's or service's availability.
4.
Notwithstanding the above, free services may be restricted, suspended, or converted into paid services based on the Company's operational policies.
5.
If a free service is converted into a paid service, the Company will notify users in advance, providing the reason for the change and the scheduled date of the transition, and obtain users' consent.
14. Membership Termination
1.
Users may terminate their service agreement at any time by submitting a withdrawal request through the Company’s official website. However, immediate withdrawal may be restricted in cases of suspected misuse.
2.
If a user violates their obligations or engages in abnormal service usage, the Company may notify the user and terminate the agreement if the violations persist after at least two warnings.
3.
Minors must obtain legal guardian consent to use paid services. Without proper adult verification, access to certain services may be restricted.
4.
If a user cancels a subscription-based or other paid service before its usage period ends, they cannot change the usage period or request a refund. Any fees already paid will not be refunded, nor will prorated refunds be allowed unless required by law.
5.
The refund policy follows the guidelines of the open market (e.g., Apple App Store, Google Play Store).
15. Compensation for Damages
1.
If the Company or a user incurs damages due to the fault of the other party, the injured party may claim compensation. However, the Company is not liable for any damages resulting from interruptions to free services, data loss, or modification.
2.
The Company is not responsible for damages unless they arise from a violation of its operational policies or service-specific terms and conditions.
3.
The Company does not have a duty to back up any user data stored on its servers for service use. Users are responsible for their data backups. The Company is not liable for data loss due to technical failures, hacking, or other unforeseen issues.
16. Disclaimer of Liability
1.
The Company shall not be held liable for any damages incurred by members or third parties due to the following reasons:
•
Inability to provide paid services due to force majeure events such as natural disasters
•
Negligence in managing personal IDs or passwords by members
•
Service disruptions caused by issues beyond the Company’s control, such as public telecommunications line failures or third-party service malfunctions
•
Intentional or negligent actions by a third party, such as a content provider or service-related affiliate
•
Any communication service issues not attributable to the Company
•
Service interruptions due to the user's fault
2.
The Company is not responsible for the accuracy, reliability, or content of any information posted by users and will not intervene in disputes between users or between users and third parties that arise through the service.
17. Ownership of Rights
1.
All copyrights and intellectual property rights for services and content provided within the service belong to the Company.
2.
The Company grants users the right to use its services under the conditions set by the Company, but users may not transfer or dispose of these rights.
3.
Notwithstanding clause a, intellectual property rights for content created by users or provided through affiliate contracts remain with their respective owners.
18. Management of Content
1.
If user-generated content violates laws or the Company’s policies, the Company may take action, including removing or suspending the content, upon request from an administrator or a relevant party.
2.
Even without a request pursuant to the previous clause, the Company may take temporary measures against content if it reasonably believes the content violates the law or its policies.
19. Copyright of Content
1.
Copyrights for content posted by users within the service belong to the respective users.
2.
Notwithstanding the above, the Company may use user-posted content for the purpose of operating, displaying, transmitting, distributing, promoting the service without separate consent and free of charge, provided it complies with copyright laws and fair business practices, as follows. When the Company uses the content, the user shall not raise any objections regarding any rights attached to the content, including portrait rights and personality rights.
•
Reproduction, modification, display, transmission, and distribution of user-generated content within the service for secondary or edited works. The Company will remove or suspend use of the content upon the user’s request, except where preservation is required by law.
•
Using content to operate, promote, improve services, or develop new services
•
Providing or displaying user content to media outlets or telecommunication companies for promotional purposes
20. Governing Law and Jurisdiction
Disputes arising from these Terms and Conditions shall be subject to the relevant laws and regulations. Regardless of conflict of law principles, the governing law shall be the laws of the Republic of Korea.
21. Provision of Information and Advertisements
1.
The Company may display advertisements, and users agree to the inclusion of such advertisements.
2.
The Company may provide users with various information and advertisements. Users may opt out of receiving advertisements, but the Company is not liable for any disadvantages resulting from this refusal.
3.
Even if users opt out of advertisements, the Company may still notify users about essential information such as changes to these Terms and Conditions via e-mail or other methods.
4.
The Company is not responsible for any losses or damages incurred by users from participating in promotional activities or transactions with advertisers.
22. Use of Content
1.
Unless restricted, users may use purchased content without additional fees or time restrictions during the service’s operational period. However, additional fees may apply for network-based content or item purchases within apps.
2.
Purchased content may only be used on the device where it was downloaded or installed. If account sharing allows device changes based on marketplace policies, those policies will apply. The Company is not responsible for content unavailability due to device changes, phone number changes, or international roaming.
23. Collection of Information
The Company may collect and utilize users’ mobile device settings and specifications to improve mobile service quality, including mobile service operation and program stabilization.
24. Paid Services and Paid Membership
1.
The Company provides the following paid services and may add or change services based on its circumstances:
•
Automatic payment service: Products in which the usage fee is automatically paid on a monthly basis through the payment method registered by the member and the usage period is automatically renewed
•
Bundled products combining educational content with additional content or services
•
Partnership products offered through agreements with other companies
2.
Contracts with individuals, organizations, or corporations providing content may affect the availability of certain paid services, and usage terms may change before or after purchase due to the provider’s request.
25. Changes to Paid Service Products
Paid services or products that members have already purchased or subscribed to cannot be modified in principle. If changes occur, the Company will notify users in advance in accordance with Article 8 of these Terms and Conditions.
